Terms of Service

1. Acceptance of Terms
By accessing or using MAGIFY properties, operated by Scott Walker (sole trader, trading as On When Out), including the MAGIFY Librarian application and public web services, you agree to be bound by these Terms of Service. If you do not agree, do not access or use the platform.
2. Early Access Programme Conditions
MAGIFY Librarian is currently in Stage-2 Early Access. Early Access software is provided on an “as is” evaluation basis. While we maintain rigorous engineering standards and secure Google Cloud infrastructure, features, database schemas, and interfaces may evolve. Early access is intended for evaluating operational memory and record continuity. Users are advised to keep independent copies of original documents.
3. Professional Advice & Sensitive Data Disclaimer
MAGIFY provides record continuity and operational memory indexing; it does not provide legal, financial, engineering, or medical advice. Stored entries, summaries, and search results reflect the user's recorded notes and uploaded files. You must inspect original source records before making legal, medical, or contractual decisions. You agree not to upload special-category health records, payment card credentials, or passwords during the Early Access evaluation.
4. User Content & Intellectual Property
You retain 100% ownership and title to all documents, notes, quotes, images, and files you store within MAGIFY. MAGIFY claims no ownership over your operational content. You grant MAGIFY only the necessary, limited licence to host, store, index, and query your content solely to deliver platform capabilities back to you.
5. Acceptable Use
You agree not to use MAGIFY to store unlawful, infringing, or malicious content, or to attempt unauthorized penetration or disruption of platform infrastructure.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Scott Walker and the MAGIFY platform shall not be liable for indirect, incidental, or consequential damages resulting from your use of the platform during the Early Access evaluation.
